Part I · Accessing the Avernoza Service

01

Acceptance of These Terms

These Terms of Service apply to all visitors, customers, account holders, and other users of avernoza.com. They include by reference our Terms of Use, the policies linked below, and any additional conditions shown for a product, promotion, application, or website feature.

If you do not agree to these terms, do not use the website or its services. Any new feature or tool added to the store will also be subject to the then-current Terms of Service unless separate terms are displayed.

02

Online Store Eligibility

You must have legal capacity to enter into these terms in your place of residence. If you are under the age of legal majority, you may use the service only with the involvement and permission of a parent or legal guardian where permitted by law.

You may not use the service for an unlawful or unauthorized purpose. You are responsible for complying with laws that apply to your access, communications, purchases, and use of products.

03

General Conditions

We may refuse, restrict, or discontinue service for a lawful and reasonable reason, including suspected fraud, security risk, prohibited activity, abuse of promotions, material breach of these terms, or conduct that harms another person or the service.

You must not reproduce, duplicate, copy, sell, resell, or commercially exploit any part of the service, access to the service, or contact through the website without prior written permission.

Headings are provided for convenience and do not limit the meaning of these terms.

04

Accounts & Security

When an account is available, you must provide accurate information, protect your password and access credentials, and promptly update information that changes. You are responsible for activity performed through your account unless applicable law provides otherwise.

Contact service@avernoza.com promptly if you suspect unauthorized account use. We may temporarily suspend access while a security concern is reviewed.

Part II · Store Information, Products & Orders

05

Accuracy and Timeliness of Information

We aim to keep website content accurate, complete, and current, but information may occasionally contain typographical errors, omissions, broken links, outdated details, or technical inaccuracies. General website content should not be the sole basis for a decision requiring professional or individualized advice.

We may correct, clarify, or update information at any time. Corrections that affect an existing order will be handled under our Terms of Purchase and applicable consumer law.

06

Products & Services

Avernoza products may include feeding bowls, drinking products, automatic feeders, smart devices, play products, resting products, accessories, replacement components, and cat furniture. Products and services may be available exclusively online and may have limited quantities.

We try to display colors, proportions, materials, finishes, and details as accurately as reasonably possible. Screen settings, photography, ceramic glazing, wood grain, textiles, production batches, and product improvements may create reasonable variation.

Review all dimensions, materials, assembly instructions, power requirements, food compatibility, weight limits, warnings, and care guidance before ordering or using a product. We may limit sales by destination, quantity, customer, household, or other reasonable criteria where lawful.

Product and editorial content is not veterinary or medical advice. A smart feeder, water product, activity product, or monitoring feature does not replace daily supervision or professional veterinary care.

07

Prices and Service Changes

Product prices, promotions, availability, and website features may change without prior notice. The amount charged for a purchase is the amount displayed and accepted at checkout, subject to correction of an obvious pricing or technical error.

We may modify, suspend, or discontinue all or part of the service for maintenance, security, legal, technical, or commercial reasons. A later change does not alter a purchase contract already accepted, except where required by law or agreed with you.

08

Orders, Billing & Customer Information

We may refuse or cancel an order before acceptance for reasons including unavailable inventory, payment failure, suspected fraud, inaccurate information, resale activity, shipping restrictions, an obvious price error, or quantities that exceed reasonable household use.

You agree to provide complete and accurate billing, delivery, contact, account, and payment information. You are responsible for checking the recipient name, street address, apartment or unit number, postal code, telephone number, and email address before submitting an order.

Further details about order acceptance, contract formation, promotions, taxes, and cancellations appear in our Terms of Purchase.

09

Payment

Available payment methods are displayed at checkout. By submitting payment details, you confirm that you are authorized to use the selected method and authorize the applicable charge, including displayed shipping charges and taxes.

Payment services may be provided by third parties and may be subject to their own terms. We may perform reasonable verification or request additional information before dispatch. If verification cannot be completed, the order may be delayed, refused, or canceled and any captured payment returned as appropriate.

10

Shipping, Returns & Refunds

Order processing, delivery estimates, tracking, multi-location fulfillment, and shipping support are described in our Shipping Policy. Products in one order may arrive in separate packages or from different facilities.

Eligible return requests may be submitted within the 180-day period described in our Return Policy. Return authorization is required before sending any product. Do not send a return to the business address or the address printed on a parcel unless Avernoza support specifically authorizes it in writing.

Part III · Digital Features and Third Parties

11

Smart Products & Connected Features

Some Avernoza products may use mains power, batteries, Wi-Fi, an app, scheduling, sensors, cooling, pumps, motors, notifications, or RFID accessories. Compatibility, available functions, technical requirements, operating limits, and any subscription requirements will be described on the relevant product page or instructions.

Connected features may depend on power, internet access, compatible hardware, correct setup, maintenance, software availability, and third-party platforms. You must continue checking your cat’s access to food and fresh water and must not rely solely on an automated schedule, notification, sensor, cooling function, or access-control feature.

12

Optional Tools & Third-Party Services

We may provide access to tools, integrations, carriers, payment processors, analytics, support systems, app stores, social platforms, or other services supplied by third parties. We do not necessarily monitor or control every third-party service.

Third-party tools are provided subject to availability and may be governed by separate terms and privacy notices. Your use of an optional third-party tool is at your discretion and should follow the provider’s applicable terms.

13

Third-Party Links

Website content may include links to independent third-party websites. A link does not mean that Avernoza owns, controls, guarantees, or endorses every statement, product, policy, or practice on the linked site.

Review third-party terms before completing a transaction or providing personal information. Questions or claims concerning an independent third-party product or service should generally be directed to that provider, subject to any legal responsibility that cannot be excluded.

14

Personal Information

Personal information submitted through the store is handled as described in our Privacy Policy. Cookies and similar technologies may be used to operate, secure, measure, personalize, and improve the service, subject to applicable consent requirements.

Do not send payment-card data, passwords, identification documents, or sensitive information through ordinary email unless our support team has provided a secure and appropriate method for the specific request.

Part IV · Content, Conduct and Brand Rights

15

User Comments, Reviews & Submissions

If you submit a review, comment, image, video, testimonial, suggestion, product question, or other material, you confirm that it is truthful, lawful, relevant, and either created by you or used with all necessary permission. Do not submit confidential information or another person’s personal data without authorization.

You retain ownership of your original content. By submitting it to Avernoza or through a feature intended for public contribution, you grant Avernoza a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, adapt for formatting, translate, publish, display, distribute, and use that content in connection with operating, improving, and marketing Avernoza, to the extent permitted by law.

We may moderate, decline, remove, or restrict content that violates these terms, contains personal information, is misleading, infringes rights, is abusive, is unrelated to the product, or creates a security or legal risk. We are not required to publish every submission.

16

Intellectual Property

The Avernoza name and Logo, product names, photography, videos, written copy, page layouts, graphics, icons, packaging presentations, and original design materials are owned by or licensed to Avernoza and protected by applicable intellectual-property laws.

You receive a limited, personal, non-exclusive, non-transferable, revocable permission to access the service for lawful, non-commercial shopping and information purposes. Without prior written consent, you may not copy, republish, sell, distribute, scrape, mirror, commercially exploit, or use Avernoza content or branding to imply affiliation, sponsorship, or authorization.

17

Prohibited Uses

You may not use the service or its content to:

  • Violate a law, regulation, court order, or third-party right
  • Impersonate another person, submit false information, create fraudulent orders, or manipulate reviews
  • Transmit malware, harmful code, spam, harassment, threats, discrimination, defamation, or obscenity
  • Collect personal information about others without a lawful basis
  • Interfere with checkout, accounts, fraud prevention, access controls, security, or website availability
  • Use bots, crawlers, scraping tools, or data-mining systems except with written permission or for lawful search indexing
  • Reverse engineer, decompile, or attempt to derive source code except where such a right cannot legally be restricted
  • Use website content to develop, train, advertise, or sell a competing commercial service without permission

We may suspend access, preserve records, remove content, cancel fraudulent activity, or cooperate with lawful requests where reasonably necessary.

Part V · Legal Provisions

18

Errors, Inaccuracies & Omissions

Information on the service may occasionally contain errors or omissions relating to product descriptions, prices, promotions, offers, shipping charges, transit estimates, stock, compatibility, or availability. We may correct information or cancel an affected order where permitted by law.

If an accepted order is materially affected by a correction, we will provide an appropriate explanation and remedy under the Terms of Purchase and applicable consumer law.

19

Disclaimer of Warranties

To the fullest extent permitted by law, the website and general service are provided on an “as available” basis. We do not guarantee that website access will always be uninterrupted, immediate, secure, compatible with every device, or free from all errors or harmful components.

Products are supplied with any express warranty stated on the product page and with all rights required by applicable consumer law. Nothing in these terms excludes a warranty, remedy, or right that cannot legally be excluded.

20

Limitation of Liability

To the fullest extent permitted by law, Avernoza is not responsible for indirect, incidental, special, or consequential loss that was not reasonably foreseeable, or for loss caused by unauthorized access, third-party services, incompatible systems, misuse, unauthorized modification, incorrect assembly, failure to follow instructions, or circumstances outside our reasonable control.

Where liability may legally be limited, our total liability arising from the service will not exceed the amount paid for the product or service giving rise to the claim. This limit does not apply to fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that applicable law does not permit us to limit.

21

Indemnification

To the extent permitted by law, you agree to be responsible for reasonable losses, claims, and costs resulting from your unlawful use of the service, material breach of these terms, infringement of another person’s rights, or content you submit.

This provision does not require a consumer to compensate Avernoza for matters caused by Avernoza or for liability that cannot lawfully be transferred.

22

Severability

If any provision of these terms is found unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

23

Termination

You may stop using the service at any time. We may suspend or terminate access if you materially breach these terms, create a security or legal risk, misuse promotions, engage in fraud, or interfere with the service or other users.

Obligations and liabilities incurred before termination remain in effect. Provisions that by their nature should continue—including intellectual-property, user-content, payment, liability, indemnification, and general legal provisions—survive termination.

24

Entire Agreement & Waiver

These Terms of Service, together with incorporated policies and any feature- or product-specific terms, form the agreement governing the Avernoza service and supersede earlier statements on the same subject.

A failure or delay in enforcing a right does not waive that right. Any ambiguity in these terms will not automatically be interpreted against one party merely because that party prepared the wording.

25

Governing Law & Consumer Rights

These terms are governed by the laws applicable to the service operator, subject to any mandatory consumer protections and jurisdiction rights available in the place where you live.

Nothing in these terms limits statutory rights or remedies that cannot legally be limited. Courts and dispute-resolution bodies with mandatory jurisdiction retain that jurisdiction.

26

Changes to These Terms

We may revise these Terms of Service to reflect changes in the service, products, technology, business practices, or legal requirements. The “Last updated” date at the top identifies the current version.

Revised terms apply from their stated effective date. Changes to general service terms do not retroactively alter an accepted purchase contract except where required by law or agreed with you.
